TERMS AND CONDITIONS

  1. “La Terrasse”, 11 Rue du Ruisseau de Nolange, 71460 St-Gengoux-le-National, France (“the Property”) is offered for holiday rental to the person named on the Booking Form (“the Client”) subject to written (e-mail) confirmation by Alison Davies or Adrian Driessen, (“the Owner”), or on their behalf by their property manager, Best of Bourgogne.
  2. To reserve the property, having confirmed availability and rental cost, the Client should complete and sign the Booking Form on behalf of his/her party and return it, together with the payment of the non-refundable deposit, or full amount if within 4 weeks of holiday, unless otherwise agreed in writing. By signing the Booking Form, the Client agrees to these Terms and Conditions.
  3. Deposit. Unless otherwise agreed in writing, the deposit required to secure the booking shall be 50% of the total rental cost. Payment can be made by bank transfer in sterling or euros. This payment must be received within 7 days of receipt of the booking form by the Client.
  4. Confirmation. Following receipt of the completed booking form and deposit, the Client will be sent a confirmation e-mail. This is the formal acceptance of the booking.
  5. The balance of the rent is payable not less than 4 weeks before the start of the rental period, unless otherwise agreed in writing. On receipt of balance the Client will receive directions to the Property and all other necessary information. No reminders will be issued. If payment is not received by the due date, the Owner may consider that the reservation is cancelled, and the reservation deposit will be lost.
  6. Cancellations. Any cancellation must be made in writing by the person who signed the Booking Form. If the cancellation is made prior to 4 weeks before the start of the rental period, the Owner shall retain the deposit. If the cancellation is made less than 4 weeks before the start of the rental period, the cost shall be 100% of the total rent if the Property cannot be re-let for the same rental period. Should for exceptional reasons the Property become unavailable, the Client will be informed immediately in writing and/or by e-mail and all monied paid will be reimbursed. The Client will have no further claim against the Owner or the property manager.
  7. Arrival and departure times. Unless otherwise agreed in writing, the rental period shall run from 16h00 on the arrival day until 10h00 on the departure day.
  8. The maximum number to reside in the property may not exceed that stated on the booking form (maximum 4 people). Sub-letting is strictly prohibited.
  9. Children. The Property is not specifically adapted for young children. Children are therefore only accepted at the Property under the strict and sole responsibility of the Client and should be supervised at all times.
  10. Animals. Pets are not allowed at the property.
  11. Smoking is not allowed at the property.
  12. Care of the Property. The Client agrees to be a considerate tenant, to take good care of the Property and to leave it in the same clean and tidy condition and state of repair at the end of the rental period as it was at the beginning. If the Property is left in an unacceptable condition The Client will be required to pay an additional fee.
  13. Security. The Client is responsible for the security of the Property during the rental period and should take all reasonable precautions to ensure security of the property when absent.
  14. Consideration to neighbours. The Client agrees not to act in a manner that would cause disturbance to residents in neighbouring properties.
  15. Parking. Cars may be parked on the street outside the property. Cars should not be parked in any position that might hinder access to other properties or their gardens.
  16. Damage to the property and/or its contents must be declared by the Client before departure and paid for if so requested.
  17. Insurance. The Client is advised to take out a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability etc. The Owner is only responsible for insuring the Property for rental purposes. The Client shall report within 24 hours any event which might give rise to an insurance claim under the Owner’s policy.
  18. Liability. The Owner accepts no responsibility for death or personal injury or for loss or damage to the Client’s belongings unless this results from the Owner’s own negligence. The Owner shall not be liable for any temporary defect or stoppage in the supply of public services to the Property or for any loss, damage, death or injury resulting from adverse weather conditions or other matters beyond the Owner’s control.
  19. Right of entry. The Client may not refuse reasonable requests for access to the property by the Owners or their representative during the rental period for the purposes of inspection, repair or maintenance.
